Terms of service

Last updated: [DATE]

1. Who we are and scope

1.1 These terms apply to all orders placed at doviejewelry.com ("DOVIE", "we", "us"). DOVIE is the trading name of [NAME], [ADDRESS], Germany, email [EMAIL] (see our Legal Notice).

1.2 Our shop is aimed at consumers, meaning people buying for purposes that are mainly outside their trade or profession.

1.3 Delivery area: We currently deliver only to addresses in Ireland, the Netherlands, Sweden, Denmark and Finland [and the United Kingdom]. You can order from any country in the EEA, as long as the delivery address is in one of these countries.

1.4 The contract language is English.

2. Products and pictures

2.1 Our jewelry is made of 316L stainless steel, many pieces with an 18K gold PVD coating. Each product page states the material and size. Our pieces meet the EU REACH limits for nickel release, lead and cadmium.

2.2 Product photos show the actual product. Some lifestyle images are created or edited with AI tools and are labelled. Small differences in colour can occur because of screen settings.

3. How a contract is made

3.1 The products in our shop aren't a binding offer. They're an invitation for you to order.

3.2 Ordering: add items to the cart, go to checkout, enter your details, choose shipping and payment, check everything on the final page (you can correct inputs any time before ordering using "back" or by editing the fields), then click "Pay now" (or the button for your payment method). That click is your binding offer to buy.

3.3 We send you an automatic order confirmation by email. It confirms we've received your order. The contract is formed when we accept your order by email (order or shipping confirmation), or when we ship the goods, whichever comes first. For payments made immediately at checkout (card, PayPal, iDEAL, Klarna Pay Now and similar), the contract is formed when the payment is processed.

3.4 Storing the contract: We store your order details. You'll receive them, together with these terms and the withdrawal information, in your order confirmation email. You can also see past orders in your customer account, if you have one.

4. Prices and VAT

4.1 All prices are final prices in the currency shown (EUR, SEK, DKK [or GBP]). Shipping costs are shown separately before you order.

4.2 VAT: As a small business under § 19 of the German VAT Act (Kleinunternehmerregelung), we currently don't charge VAT on EU orders, and none is shown on your invoice. [Once applicable: EU orders include the VAT of the delivery country. UK prices include UK VAT at 20%.]

4.3 Discounts: Discount codes can't be combined unless stated, can't be paid out in cash, and apply only during the stated period. When we show a reduced price, the reference price is our lowest price in the 30 days before the reduction.

5. Payment

5.1 We accept the payment methods shown at checkout, e.g. credit/debit card, Apple Pay, Google Pay, PayPal, iDEAL | Wero (NL), Klarna, MobilePay (DK/FI), Swish (SE). The methods available depend on your country and currency.

5.2 Payment is due when you order. For Klarna's "pay later" or instalment options, Klarna's terms apply between you and Klarna.

6. Delivery

6.1 Delivery times, costs and countries are explained in our Shipping Policy. Usual delivery time is 7–15 business days after dispatch from our fulfilment partner's warehouse outside the EU; any import duties are paid by us. Orders may arrive in more than one parcel, at no extra cost.

6.2 Risk of loss or damage passes to you only when the goods are handed to you (or to a person you've named, other than the carrier).

6.3 If a product turns out to be unavailable after you order, we'll tell you right away and refund any payment immediately.

7. Right of withdrawal

As a consumer you have a 14-day right of withdrawal. You can also use our "Withdraw from contract" button in the footer. Full details, the model withdrawal form and our voluntary 30-day return promise are in our Returns & Withdrawal Policy.

8. Your legal rights if something is wrong (legal guarantee)

8.1 You have the statutory rights for goods that aren't in conformity with the contract: repair or replacement, price reduction or termination. In the EU this lasts at least two years from delivery. Depending on your country it can be longer: for example, Sweden 3 years to complain; in the Netherlands and Finland, for the expected lifespan of the product; in Ireland and the UK, up to 6 years to bring a claim (UK: plus a 30-day right to reject faulty goods under the Consumer Rights Act 2015).

8.2 Please email [EMAIL] with your order number and a photo of the problem. We pay the costs of returning faulty goods.

8.3 Normal wear (scratches from everyday use, damage from misuse such as strong chemicals, chlorine or excessive force) isn't a defect. Your statutory rights aren't affected by this sentence.

9. Our 1-year Tarnish Promise (voluntary commercial guarantee)

9.1 Guarantor: [NAME], trading as DOVIE, [ADDRESS], Germany, [EMAIL].

9.2 What's covered: If the gold PVD coating of a DOVIE piece visibly tarnishes, discolours or wears through within 12 months of delivery despite normal use, we'll replace the piece with the same or an equivalent item. If that isn't possible, we'll refund the price you paid for that piece.

9.3 Not covered: loss; breakage from force or accidents; damage from abrasive cleaning, chemicals or alterations; hair accessories and cases [owner to decide]; normal scratches.

9.4 How to claim: email [EMAIL] within the 12 months with your order number and photos. We may ask you to send the item back. We pay for this return.

9.5 This promise is in addition to your statutory rights (section 8) and doesn't limit them. Using our Tarnish Promise is free of charge.

10. Liability

10.1 We're fully liable for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and under any guarantee we've given.

10.2 For slight negligence, we're liable only for breach of essential contractual obligations (obligations whose fulfilment makes the contract possible and on which you can normally rely), limited to typical, foreseeable damage.

10.3 Nothing in these terms limits liability where the law doesn't allow it.

11. Reviews

Reviews on our website come from customers who placed an order with us ("Verified buyer"). We ask by email after delivery. We publish positive and negative reviews alike. We only remove reviews that are spam, offensive, or unrelated to the product. We never pay for reviews.

12. Applicable law and courts

12.1 These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law doesn't deprive you of the protection of mandatory consumer-protection rules of the country where you normally live (Art. 6 Rome I Regulation; for UK customers, the equivalent UK rules).

12.2 You can bring a claim in the courts of the country where you live.

13. Disputes

Please contact us first at [EMAIL]. We almost always find a solution. We're neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. EU consumers can find information on out-of-court dispute resolution bodies at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies.

14. Other

If one clause of these terms is invalid, the rest stay valid. The invalid clause is replaced by the statutory rules.
